Montblance and Roger Cromwell have resolved the lawsuit brought by Montblanc concerning the advertisement for sale and sale of Montblanc-branded pens that had artwork, including erotic artwork, added to them after-market. Mr. Cromwell agrees with Montblanc that it is unlawful trademark infringement for third-parties to promote the sale of or sell altered brand name products. This conduct deprives consumers of the manufacturer's warranty and my result in inferior performance specifications due to unauthorized alterations, and may cause dilution and tarnishment of the trademarks retained on the products.

So it sounds like Roger lost and thus after market modifications are illegal in the eyes of the manufacturer. He just didn't get fined.

I sure hope I don't need to try to sell my car soon. It has aftermarket leather in it that I had done...

Absolutely ridiculous on MB's part. I've got one MB and I will never purchase another. In fact, I might even sell my 146 after this... since I have a Cold War Pel on the way.

Again, I would encourage people not to jump to conclusions here without full knowledge of the events, which none of us have except for the parties involved.

 

I've seen the archived original webpage with the sale listing of the pen in question. It was my impression, that the wording was ambiguous, making it very possible that some viewers might interpret the "erotically-themed artwork" as something that was sanctioned and possibly even commissioned by MB. Initially, I was extremely anti-MB on this matter, but after seeing that website, I no longer knew whose side I was on and decided to stay out of it.

I look after Roger's web site and other technical things like his email. Roger asked me to post this for him.

Ron,

 

Off topic, but my wife tried to email Roger about a MB pen that was advertised on the Penopoly site, but she never got a response.

That was several weeks ago. Was there a technical problem recently?

Roger has some nice pens on his website. Unfortunately his poor record for returning emails and replying to inquiries from customers who have sent or given their pens to him to repair precludes me and many others from doing business with him. I am glad he has settled with MB. I thought that was a witch hunt to make someone an example to start with and has permanently colored my opinion of MB as a bully and overbearing. I understand the legal defense cost Roger a bundle and that sucks big time.

 

I do wish him success in his business, it just won't be from me.

I tend to agree with QM2 that it is difficult to know everything behind the story including what MB got and what Roger Cromwell lost. But after reading this thread I wonder how dropping sales of "precious resin" ballpoints and rollerballs are going to affect MB.

      Oh to have that translucent pink Prera! @migo984 has the Oeste series named after birds. There is a pink one, so I’m assuming Este is the same pen as Oeste.    Excellent haul. I have some Uniball One P pens. Do you like to use them? I like them enough, but don’t use them too much yet.    Do you or your wife use Travelers Notebooks? Seeing you were at Kyoto, I thought of them as there is a store there.

      It's not nearly so thick that I feel it comprises my fine-grained control, the way I feel about the Cross Peerless 125 or some of the high-end TACCIA Urushi pens with cigar-shaped bodies and 18K gold nibs. Why would you expect me or anyone else to make explicit mention of it, if it isn't a travesty or such a disappointment that an owner of the pen would want to bring it to the attention of his/her peers so that they could “learn from his/her mistake” without paying the price?

      Why nobody says that the section of Tuzu besides triangular shape is quite thick. Honestly it’s the thickest one among my many pens, other thick I own is Noodler’s Ahab. Because of that fat section I feel more control and my handwriting has improved. I can’t say it’s comfortable or uncomfortable, but needs a moment to accommodate. It’s funny because my school years are long over. Besides this pen had horrible F nib. Tines were perfectly aligned but it was so scratchy on left stroke that collecte

      @asota -- Yeah, I think I have a few rolls in my fridge that are probably 20-30 years old at this point (don't remember now if they are B&W or color film) and don't even really know where to get the film processed, once the drive through kiosks went away....  I just did a quick Google search and (in theory) there was a place the next town over from me -- but got a 404 error message when I tried to click on the link....  Ruth Morrisson aka inkstainedruth
