Shipments going OUTSIDE of the EU are EXEMPT from VAT...this is not a grey area, it is not dependent upon the business registration, it is not complicated.  This is the SAME for ALL EU member countries.

Yes, but small companies are outside the VAT system. I believe that Fountainfeder (if they are a small company) should not note VAT at all. Because formally, they do not charge VAT. They sell for some price which is the same for all customers. And because they pay VAT on all inputs, this price on the output must reflect this (and correspond to VAT-inclusive price charged by large competitors participating in the VAT system).

Well they do list VAT, and when you check out the check out system indicates to the buyer the total amount of the VAT...and then you look for the VAT to be deducted if the shipment is outside of the EU (as is the case with other EU sellers)..and it doesn't get deducted...

 

Additionally, Stefanie says:  ""Germany has some pretty straight forward tax laws. All international sales outside the EU have to include TAX, unless it is sold to a distributer or business".. Since I only sell business to customer, the tax can not be removed from the bill. That is why it is not removed from your total during checkout. There is honestly nothing I can do about it"

 

Makes no sense at all.

I think they should not. But I don't know the details about German tax law nor the status of Fountainfeder.
