Just A Quick Question About Returns...

Hey guys,

So recently I was at a newsagency. They had a section which was filled with reduced items from their christmas sale. One of these items was a three pen Sheaffer Calligraphy set. I purchased this item. Upon bringing it home, I filled up the pens, and began to write. At first I was quite impressed. Then I looked at my hands. They were covered in ink. There was ink leaking from some where on al the pens, making ink cover the section. Frustrated, I washed these pens, flushed them out, and put them away. The next time I touched them was a couple of days later. The same thing happened. I had no idea why none of these calligraphy pens were working as they should. I tried fiddling around with them, checking the tines, as well as other methods, but to no avail. Next time I went past this same newsagency, I brought back this set, along with my receipt. I showed the pens to the man behind the counter, who recognised me from selling the pens to me a week ago. I was told that I was not able to receive a refund, or an exchange, as it was no longer the problem of the newsagency, but now the problem of Sheaffer. Frustrated, I brought these pens back home, and had a look at sending them to sheaffer. There was not a Sheaffer repairs centre in my whole state, and sending the pens to get repaired would cost as much as they did in the first place.

 

I am just asking a question to FPN. Should I have been allowed a refund or exchange, as the pens I bought were faulty? I can't be bothered sending them to Sheaffer, not with so many other things going on at the moment. Has anyone had a similar experience with returns?

The short answer is yes, you should have been allowed a refund from the retailer who sold the pens to you. He is the person who you have your contract with, not the pen manufacturer, so he is the person who should have taken the faulty goods back and given you a refund.

 

For future purchases, this is always the case.

It really depends on consumer protection legislation in the locality where you purchased them, so I would do a little research and establish what your rights are.

 

This scenario in the UK is simple. Your contract is with the retailer, and it is the retailer's responsibility to either replace, refund or send for repair.

You hands covered in ink means the section threads are probably leaking. Are you using these as eyedroppers? If so try using a cartridge.

I believe that if the item you purchased is defective and does not function as it should, such that if you had known about it you would not have purchased the item, then you should be able to return the item to the retailer? I am under the impression that the scenario is similar to in the UK, and that the contract is with the retailer.

 

You could check the Trade Practices Act, nd there should be some government websites on consumer rights/protection. That being said, it might still be hard getting your newsagent to issue a refund if they don't want to. :\

Do you know how to use cartridge pens, specifically the inserting the cartridge part? And did you stop shaking them?
