Who is this guy? giacomobehar3wkj

He's using one of my photos to sell a Mb Agatha Christie and didn't have the decency to ask my permission, even though all of my photos are tagged "All rights reserved" and most are tagged "Do not use without my written permission."

Here's his link: http://cgi.ebay.com.au/MONTBLANC-LIMITED-EDITION-AGATHA-CHRISTIE-BALLPOINT-NR_W0QQitemZ250538801937QQihZ015QQcategoryZ29828QQcmdZViewItemQQ_trksidZp3911.m7QQ_trkparmsZalgo%3DLVI%26itu%3DUCI%26otn%3D1%26ps%3D6

I've reported to eBay, but I'm ticked off. I'm not in the business of selling other people's stuff, and especially not for free.

Grrrr...

That is very odd!! Did you see the price for shipping?

Someone else posted about this a few threads down.

Blessings to you ethernautrix, I hope it gets straightened out.

If you contact eBay I should think they'll issue him with a takedown notice or just cancel the auction -- they are bound by the same copyright rules as everyone else.

I'd be satisfied if he stopped using my photo(s). An apology would be a bonus.

Hey, Ricky, thanks for the link. I'm appalled that a lawyer (if that's the guy) wouldn't know not to steal other people's artwork. I wonder if I could hire him to sue himself, ha! Thief.

You should hire his partner Tatyana (if he's the one). It would be only more ironic if the guy was an intellectual property attorney.

The internet is kinda scary. I was able to do a lot of digging on this guy in 5 minutes. I love the one feedback on yahoo.

He has sent me a reply:

:Dear ethernautrix,

Where did I use "your" photo? Please let me know.

Sent from iPhone. Please forgive any typos or terseties.

Kind Regards,

Giacomo Jacques BEHARAttorney at Law

I love the insinuation of putting "your" in quotation marks. Oh you know "my" photo, the one with "my" name on it!

Intellectual property is the only area in which attorneys are allowed to claim they "specialize" in -- there is even a separate (patent) bar exam for it. My guess is he doesn't understand copyright law.

If he does take the photo down, guilty as hell he would be and you've accomplished something.

If you want proof that he used the photo, can't you save his entire ebay page with the photo?

Ah, that fresh ink on paper look!

I will start calling him Jerkomo. If you need help writing a nasty letter, let me know. I specialize in those, but I'm not an attorney. Just someone who excels at writing nasty letters. Send him an email with the subject line "CEASE AND DESIST."

I subscribe to The Rule of 10 (pens, that is)

Lisa you might want to start taging the face of your photos with the copyright symbol and year. It dosn't have to be big just visable like on this shot. http://modelmayhm-5.vo.llnwd.net/d1/photos/070915/09/46ebeed411062.jpg

This lawyer is also using sunnerd's photos in the same listing, also without sunnerd's permission. Sunnerd wrote about it here: link.

Sunnerd alerted me, otherwise, I wouldn't have known.

I have the Sailor Naginata and some fancy blade nibs coming after 2022 by a number of new workshop from China.  With all my respect, IMHO, they are all (bleep) in doing chinese characters.  Go use a bush, or at least a bush pen.

It is the reason why I'm so keen on the idea of a personal library — of pens, nibs, inks, paper products, etc. — and spent so much money, as well as time and effort, to “build” it for myself (because I can't simply remember everything, especially as I'm getting older fast) and my wife, so that we can “know”; and, instead of just disposing of what displeased us, or even just not good enough to be “given the time of day” against competition from >500 other pens and >500 other inks for our at

Agreed.  And I think it’s good to be aware of this early on and think about at the point of buying rather than rationalizing a purchase..

Alas, one cannot know “good” without some idea of “bad” against which to contrast; and, as one of my former bosses (back when I was in my twenties) used to say, “on the scale of good to bad…”, it's a spectrum, not a dichotomy. Whereas subjectively acceptable (or tolerable) and unacceptable may well be a dichotomy to someone, and finding whether the threshold or cusp between them lies takes experiencing many degrees of less-than-ideal, especially if the decision is somehow influenced by factors o

I got my first real fountain pen on my 60th birthday and many hundreds of pens later I’ve often thought of what I should’ve known in the beginning. I have many pens, the majority of which have some objectionable feature. If they are too delicate, or can’t be posted, or they are too precious to face losing , still they are users, but only in very limited environments..  I have a big disliking for pens that have the cap jump into the air and fly off. I object to Pens that dry out, or leave blobs o
